1. Object
1.1. Through these conditions (henceforth the Terms of Use) the access, browsing and use of website perspectiva10.grupovermon.com (henceforth, the Web) are regulated, as well as the responsibilities arising from the use of its contents (including texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information, as well as any other creation protected by national and international regulations on intellectual and industrial property) by all users who visit it (henceforth, the User).
1.2. The Terms of Use also regulate the sending by any means (in particular by mail or by email) or uploading of texts, drawings, photos and digital videos to Perspectiva 10, S.L. for its dissemination through the Web pages.

1.4. Browsing the Web and sending or uploading a text, photo, video or any other content (henceforth, materials) by the User, implies full and unreserved adherence to each and every one of the Conditions of Use.
2. Intellectual and Industrial Property Rights
2.1. Perspectiva 10 is the exclusive licensee of exploitation of intellectual property and industrial property of the Web and of contents available through it.
2.2. In no case shall it be understood that allowing Users to access the Web implies a waiver, transmission, license or total or partial cession of such rights by Perspectiva 10.
2.3. It is expressly forbidden to suppress, evade or manipulate the copyright and any other identification data related to the rights held by Perspectiva 10.
2.4. Those committing crimes of this type may face prison sentences of up to four years, in addition to resulting fines and different civil responsibilities that may arise from the commission thereof.
3. Guarantees and Liabilities
3.1. Perspectiva 10 does not guarantee the legality, reliability, utility, veracity or accuracy of the data, programs, information or opinions that are accessible on the Web.
3.2. Perspectiva 10 does not guarantee: (i) Continuity and accessibility to Web contents; (ii) the absence of errors in its contents; (iii) the absence of viruses and/or other harmful components on the Web or in the server that supplies it; (iv) the vulnerability of the Web; (v) the liquidated damages caused, to itself or to a third party, anyone who infringes the conditions, policies and instructions that Perspectiva 10 established on the Web or that violates the security systems of the Web.

4.1. The User may find on the Web links to other websites through different buttons, links, banners, and others. Perspectiva 10 does not assume any responsibility with regard to web pages or website which the links offer.
4.2. Perspectiva 10 will not control nor approve any information, content, product or service provided on web pages linked to the Web that do not belong to Perspectiva 10. Perspectiva 10 assumes no responsibility or liability for the contents of any third party linked site or any link contained in a linked site.
5. Duration and Amendment
5.1. Perspectiva 10 may modify the terms and conditions stipulated herein at any time and unilaterally.
5.2. Perspectiva 10 can terminate, suspend or interrupt unilaterally, at any time, without prior notice, access to the content of the page, excluding the Consumer from the rights to solicit any kind of compensation.
6. Materials
6.1. Users hold sole responsibility for sending or uploading materials to the Web and for publishing or disseminating them through the Web. Users guarantee that the Materials uploaded or sent are their own or that they have the necessary licenses and permits to authorize Perspectiva 10 to publish and disseminate the materials.
6.2. Users guarantee that they have the written consent of each and every one of the identifiable people that appear in the Materials for the publication and dissemination of their image and their name, through the Web.
6.3. The User explicitly states that he will not sent or uploaded to the Website do not damage third parties or Perspectiva 10. The User guarantees that the Materials do not include images, sounds or texts that may be illegal, morally reprehensible, defamatory, threatening, pornographic or racist. Users guarantee that the Materials do not infringe any rights of image, intellectual or industrial property or infringe the honour or dignity of no person. The User who submits or uploads Materials to the Web automatically grants Perspectiva 10 a free, non-exclusive, sublicensable license to third parties for the use, reproduction, distribution, transformation, public communication and being made available to the public of the Materials worldwide, and for the maximum term foreseen for assignments in article 26 of the Restated Text of the Law on Intellectual Property. The User authorizes Perspectiva 10 to distribute and disseminate the Materials in any means of communication, in particular, through Internet. The license granted does not entail the publishing or dissemination of the Materials by Perspectiva 10. Perspectiva 10 will decide whether or not to publish a certain Material, and when and for how long it will be published.
6.5. Perspectiva 10 disclaims any responsibility arising from the publication or dissemination of user’s materials. Perspectiva 10 will remove any material that can be a violation of rights of intellectual or industrial property, right to image, right to honour and privacy or any other legal precept, provided that the existence of such infringement is duly notified. Users will respond to third parties and to Perspectiva 10 for any judicial or extrajudicial claim in relation to the materials, their publication or their dissemination by any means.
7. Generalities
7.1. The headings of the different conditions are only informative, and will not affect, qualify or extend the interpretation of the Terms of Use.
7.2. In the event that any provision of these Terms of Use is considered null or non applicable in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or non-application will not affect the other provisions of the Terms of Use nor to the particular conditions of the different services of the Web.
7.3. The non-exercise or execution by Perspectiva 10 of any right or provision contained in these Terms of Use will not constitute a waiver thereof, unless acknowledgment and agreement in writing by Perspectiva 10.
8. Jurisdiction
8.1. These Terms of Use are in accordance with Spanish law.
8.2. All parties, with express waiver to its jurisdiction, submit all interpretations or disputes that may arise as a result of this Terms of Use to the Courts and Tribunals of Valencia.
